The legal battle over the removal of Lagos State House of Assembly Speaker, Mudashiru Obasa, took another turn on Friday as Justice Yetunde Pinheiro of the Lagos State High Court, Ikeja, adjourned the case to Monday. The adjournment will allow the court to hear all pending and newly filed applications related to the dispute.
Justice Pinheiro directed all parties involved to file and exchange necessary legal documents before the next hearing.
Lawmakers Seek Dismissal of Case
Among the pending applications is a request from the Deputy Speaker and 36 lawmakers urging the court to dismiss the case, arguing that it has become a mere academic exercise.
Adding another layer to the case, two new legal representatives, Olusola Idowu and Senior Advocate of Nigeria (SAN) Clement Onwuenwunor, appeared on behalf of the four lawmakers who opposed Obasa’s impeachment. They also filed fresh applications to join the suit.
Obasa’s Lawyer Insists Removal Was Unlawful
Speaking outside the courtroom, Obasa’s lawyer, Fashanu, maintained that the impeachment process was flawed, alleging a lack of due process and fair hearing. He stated that his client is also challenging the accusations leading to his removal, which include fraud, high-handedness, abuse of office, and gross misconduct.
Counterclaims from Other Lawmakers
Meanwhile, a lawyer representing 34 lawmakers who have joined the case, Romeo Michael, insisted that Obasa’s impeachment was lawful under Section 92 of the 1999 Nigerian Constitution. He argued that the Lagos Assembly’s internal rules do not override constitutional provisions.
Obasa Challenges Impeachment in Court
Obasa, however, contends that his removal on January 13, 2025, was illegal, as it occurred while the Assembly was in recess and while he was out of the country. In a suit filed on February 12, he is asking the court to declare the action of his colleagues unlawful.
