Court Restrains EFCC From Arresting Kwankwaso, Others %Post Title

A Kano High Court sitting at the Audu Bako Secretariat has issued an order restraining the Economic and Financial Crimes Commission (EFCC) from taking any action against the presidential candidate of the New Nigeria Peoples Party (NNPP) in the 2023 election, Rabiu Musa Kwankwaso and seven others.

Applicants in the case include the NNPP, Dr Ajuji Ahmed, Dipo Olayanku, Ahmed Balewa, Chief Clement Anele, Lady Folshade Aliu, Buba Galadima, an engineer, and Senator Rabiu Musa Kwankwaso, while the respondent is the EFCC.

Justice Yusuf Ubale Muhammad granted the order after considering a motion exparte dated and filed on June 5, along with a verifying affidavit containing four paragraphs, a 27-paragraph affidavit in support, exhibits NNPP 1-NNPP 9 attached and a written address, all dated June 5.

The court’s ruling stated, “An interim order of injunction is hereby granted, restraining the respondent, either by itself, its agents, representatives, cronies or whosoever acting on its behalf, from arresting, detaining, harassing, intimidating, inviting, or in any way infringing on the fundamental rights of the applicants pending the hearing and determination of the motion on notice already filed.”

Additionally, the court ordered that the interim order, the motion on notice and all other processes in the suit should be served on the respondent promptly and before the adjourned date.

The case has been adjourned to June 24, 2024 for the hearing of the motion on notice.
